1. Acceptance of terms

By accessing synthologysolutions.com or any of its subdomains and related properties (“the site”), you agree to these terms. If you don’t agree, don’t use the site.

These terms govern site use only. They do not govern your use of any Synthology product or service — those are covered by the Synthology Master EULA, applicable EULA Annexes, the Master Services Agreement, and product- specific Statements of Work.

2. Permitted use

You may use the site to learn about Synthology, our products and services, our regulatory posture, and to contact us. You may not:

• Scrape, mass-download, or systematically extract content for redistribution
• Attempt to gain unauthorized access to any part of the site, our infrastructure, or the underlying source repository
• Use the site to transmit malware, phishing content, or other harmful payloads
• Misrepresent your identity, organization, or intent in web-form submissions
• Use the site or its content to compete with Synthology in ways that violate intellectual-property law

3. Information accuracy

Site content reflects our practices, products, and regulatory positions as of the effective date shown. We update content as the underlying facts change, but content may become out-of-date between updates. Statements about product capabilities, regulatory status, and roadmap items are not warranties.

Regulatory framing: Every Synthology and XyDromatics product described on this site is non-device software under FD&C Act §520(o)(1)(D) (added by §3060 of the 21st Century Cures Act of 2016) — not an FDA-regulated device and not subject to FDA premarket clearance requirements. See /regulatory for the statutory basis. As shipped and as purchasable, no product is a current or pending medical device. The site does not constitute marketing of medical devices.

7. Limitation of liability

To the fullest extent permitted by law, Synthology and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the site, including but not limited to lost profits, lost data, or business interruption — even if Synthology has been advised of the possibility of such damages.

This limitation applies to site use only. Liability for actual product or service engagements is governed by the applicable Master Services Agreement and Statement of Work.

8. Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of- laws principles. Any dispute arising out of or relating to these terms or your use of the site will be resolved in the state or federal courts located in Escambia County, Florida, and you consent to personal jurisdiction in those courts.

9. Modifications

We may revise these terms at any time by posting an updated version on this page. Continued use of the site after changes are posted constitutes acceptance of the revised terms. Material changes are reflected in the effective date at the top of this page.

10. Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with the Privacy Notice, constitute the entire agreement between you and Synthology with respect to your use of the site, and supersede any prior site-use agreements between us.
